President Trump has been impeached

Interesting side issue: “Rep. Tulsi Gabbard of Hawaii, who is running for the Democratic presidential nomination, voted ‘present’ for both articles.”

  1. Its on the record for the history books now, that’s all that matters. Historians in 100 years will look back on Trump and each and every one of his voters as the most inept, unintelligent, and corrupt President and followers in US history.

Pelosi should keep the articles in limbo, as both McConnell and Graham have admitted as much being corrupt cronies for Trump. Compile evidence and turn it over to federal prosecutors once Trump is out of office to be charged with treason for using his own personal gain as leverage for United States military decisions.

    1. I think both sides should lay off the “treason” rhetoric. It seems to me that Trump did not commit treason, but he did come very close.

Here is the definition in the Constitution: “Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.”

This language was drawn from a 1351 statute in England that was specifically designed to limit the scope of treason. Because the definition is so narrow, it is all but impossible to convict somebody of treason during peacetime because there are no “enemies.” An enemy is a nation or an organization with which the United States is in a declared or open war. To do so in the present, one would have to fight for, or give aid and comfort to, somebody like Isis, al-Qaeda or the Taliban, and even that charge would result in a protracted legal battle about the definition of an “enemy.” (The best chance to obtain a conviction today would probably be against the Americans who fought for or aided ISIS, thus causing American soldiers to die in battle.)

Because of the highly specific definition, no American has been convicted of treason for any post-WW2 activity. Even the Rosenbergs, who conspired to give atomic weapons to Stalin, were not charged with treason because the Soviet Union was not our “enemy.” (They were instead convicted of conspiracy to commit espionage.)

      However.

Russia is an enemy of Ukraine. They are at war. Russia has already invaded and occupied Crimea, and the land grab continues with fighting on Ukraine’s eastern border. Ukraine is our ally. We provide them with military assistance. So the legal/constitutional question then becomes, “Is the enemy of my ally also my enemy?” It is possible to make a case for that.

In case the answer is yes, it would be treasonous to withhold improperly any Congressionally-approved military assistance to our ally, since to do so would be to give aid and comfort to our enemy. I personally think the answer should be “no,” and that the scope of treason was limited for a reason, so I would conclude that President Trump has not committed treason.

But he has come ever so close – closer than any other prominent American that I can recall.

      1. It is treason de facto, if not treason de jure. IMO, of course, which is no better than anyone except Brobonk’s.

  2. After several days for the ping pong debates with one side saying it’s a slam dunk case and the other that it was totally groundless without a shred of evidence I’m mainly just sick of it. I know impartiality is a high ideal but politicians are not even trying anymore.

  3. The sham impeachment will end up before the Supreme Court before it ever goes to the Senate. Trump will remain president, and his re-election was all but guaranteed yesterday.

    1. The Constitution specifically prohibits the Supreme Court from interfering, but you may be right about the rest. He will remain in office, and there is a very good chance he will be re-elected.

  4. Impeachment is the only right thing to have done. It is great that there is still enough good left in our politics and politicians to do this.

Trump will NOT be impeached in the Senate. The Republicans are far to rotten for that. But they will be nailed to the cross of Trump forever. I hope that matters in America’s future.
