    1. What if you did it in the USA to prisoners?

      The Bill of Rights (8th Amendment) declares “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”

      It seems cruel, and it’s indisputably unusual, so you can definitely argue that it’s unconstitutional.

      1. It’s cruel, but if more people did it it wouldn’t be unusual.

        I assume there has been a previous test of whether they must be both.
